Article 1 – Definitions

In these General Terms and Conditions, the following terms shall have the following meanings:
‘Customer’: the (future) contracting party of Bme Science BV to whom a Quotation is made and/or with whom an Agreement is concluded, as well as all companies affiliated with the Customer.
‘General Terms and Conditions’: these General Terms and Conditions that apply to every Quotation from Bme Science BV, every acceptance by the Customer of a Quotation and, in general, every Agreement between Bme Science BV and the Customer.
‘Goods’: all goods delivered by Bme Science BV within the framework of an Agreement.
‘Bme Science BV’: the trade name of the private limited company Bme Science BV, with registered office at Vennenhof 11, 9800 Deinze, Belgium, company number 1019.351.521.
‘Services’: all services provided by Bme Science BV within the framework of an Agreement.
‘Special Conditions’: specific conditions that govern the Agreement between the Customer and Bme Science BV and that take precedence over these General Terms and Conditions.

Article 2 – Conclusion and amendments to the Agreement

Every Quotation is without obligation until accepted by the Customer. The Quotation contains a complete and accurate description of the Goods and/or Services offered. If Bme Science BV uses images, these are a true representation of the Goods and/or Services offered. Obvious mistakes or errors in the Quotation are not binding on Bme Science BV.

A Quotation is only accepted by signing and returning the Quotation to Bme Science BV or by electronic confirmation by email to hi@bmeskin.com. After confirmation, the Agreement is considered to be fully and legally concluded.

Acceptance of these General Terms and Conditions implies that the Customer fully waives the application of its own general terms and conditions.

Changes to the Agreement must always be requested in writing and confirmed by Bme Science BV. If changes entail additional costs or work, these may be charged to the Customer.

Article 3 – Delivery

Unless otherwise agreed in the Special Terms and Conditions, the Agreement includes:

  1. the delivery of the Services, such as health advice via our online screening tool and/or a personal consultation, as well as possible active follow-up via, for example, reminder messages via WhatsApp.
  2. the sale and delivery of Goods.

Bme Science BV strives to execute orders as quickly as possible, within 30 days at the latest, unless otherwise agreed.
If delivery is delayed or cannot be completed, the Customer will be informed no later than one month after the order was placed.
Bme Science BV may outsource the execution of the order in whole or in part to third parties.
In the event of force majeure, Bme Science BV may suspend or terminate the Agreement without compensation.
The risk of loss or damage remains with Bme Science BV until the moment of delivery to the Customer.

Article 4 – Price and payment

In the case of a subscription, the amount due will be collected automatically in accordance with the terms set out in the Special Conditions.
Orders placed via the webshop are paid for using electronic payment methods in the online payment module.
Invoices must be paid within 30 days of the invoice date, unless otherwise agreed.
In the event of late payment, Bme Science BV may suspend deliveries and take back Goods already delivered. The Customer shall owe a fixed compensation of 10% of the outstanding amount (with a minimum of €50.00), as well as default interest at the statutory interest rate.

Article 5 – Right of withdrawal (statutory 14 days)

The Customer has the right to return Goods within 14 calendar days after receipt without stating a reason.
During this period, the Customer must handle the Goods and their packaging with care.

The right of withdrawal is exercised by:
notification via the contact form on the website, or
submission of the official withdrawal form.

The cost for return shipping is €8. This fee is charged to cover shipping and handling costs. Returned products cannot be resold due to hygiene and quality control reasons.

The right of withdrawal does not apply to:
Goods made to the Customer’s specifications;
Goods with a limited shelf life;
Goods whose seal has been broken after delivery (such as supplements).

Bme Science BV will issue the refund within 30 days after receipt of the returned Goods.

Article 6 – Commercial 28-day Money-Back Guarantee (only for Clear Skin subscriptions)

In addition to the statutory right of withdrawal, Bme Science BV offers a voluntary commercial money-back guarantee on the first subscription delivery of the Clear Skin product. This guarantee does not apply to other B.me products or formulas. The guarantee can only be used once per customer, delivery address, household, payment method or account. Promotions, trial products and temporary offers are excluded. The Customer may submit a request within 28 days of receiving the first Clear Skin subscription delivery if they are not satisfied.
The request must always be submitted by email to hi@bmeskin.com. Requests via social media, WhatsApp or other channels will not be processed.
The request must include:

  • full name
  • order number
  • date of order
  • delivery address
  • a brief explanation of the dissatisfaction (for product and quality improvement purposes only)

Bme Science BV reserves the right to refuse requests in cases of suspected abuse, fraud or inconsistencies.
After approval, the Customer will receive return instructions. Returns without prior email notification will be refused.
For a refund, the Customer must:

  1. return the complete original packaging of the first Clear Skin box;
  2. make the return within 7 calendar days of receiving the return instructions;
  3. bear all return costs in full.

Incomplete, damaged or randomly packaged returns may be refused.
Upon correct receipt, Bme Science BV will refund the value of the first Clear Skin subscription delivery via the same payment method within a maximum of 14 days.
The following costs will not be refunded: shipping costs, return costs, follow-up deliveries or future subscription payments.
This commercial guarantee does not affect the Customer's statutory rights.

Article 7 – Liability

Bme Science BV cannot be held liable for:

  • use of Goods contrary to the instructions;
  • incorrect or incomplete information provided by the Customer;
  • failure to achieve health objectives.

Liability only applies in cases of fraud, intent or gross negligence. It is limited to the invoice amount, unless the insurer determines otherwise.

Article 8 – Duration and termination

Subscriptions are entered into for the duration stated in the Special Conditions and are automatically renewed unless the Customer gives written notice of termination at least 14 days before expiry.

Bme Science BV may terminate the Agreement immediately in the following cases:

  • if the Customer fails to fulfil their obligations;
  • in the event of bankruptcy or dissolution of the Customer. 

Article 9 – Intellectual property

All designs, texts, advice and methods of Bme Science BV remain the property of Bme Science BV at all times and may not be used, reproduced or distributed without prior written permission.

Article 10 – Applicable law and competent court

These General Terms and Conditions are governed by Belgian law.
All disputes fall under the exclusive jurisdiction of the courts of Ghent, Belgium, unless the Customer is a consumer and can appeal to the Consumer Ombudsman Service.
